Transamerican Auto Parts “Life Is Better Off-Road ™” Award

NO PURCHASE NECESSARY TO ENTER OR WIN.

 

ELIGIBILITY:

OPEN ONLY TO OFFICIAL EXHIBITORS OF THE 2016 SEMA (Specialty Equipment Market Association) SHOW, WHO ARE AT LEAST 18 YEARS OF AGE AND WHO HAVE A VALID EMAIL ADDRESS. VOID WHERE PROHIBITED.

 

Employees and their immediate families (i.e., parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households (whether or not related) of TAP Worldwide, LLC dba Transamerican Auto Parts (TAP) and its respective subsidiaries are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of TAP, which are binding and final on matters relating to this contest. Contest is subject to all applicable federal, state and local laws.

 

CONTEST DESCRIPTION:

The “Life is Better Off-Road” award is an annual industry prize awarded by Transamerican Auto Parts to the best presented, truly off-road capable truck, Jeep or SUV on display at the SEMA show. This award is open to all off-road vehicle constructors and product manufacturers in attendance at the SEMA show as judged by an elite panel of industry experts. The Transamerican Auto Parts “Life is Better Off-Road” award recognizes the unique technological achievements and engineering advancements specific to the development of aftermarket products for off-road trucks, Jeeps and SUVs.

Vehicle owners must be able to deliver the vehicle to the 2016 SEMA Show. Owner is responsible for transporting vehicle to and from the SEMA Show in Las Vegas, Nevada. Owner is responsible for securing booth space and fulfilling all requirements as an official exhibitor in the SEMA show. The SEMA Show is a trade-only event not open to the general public.

 

CONTEST PERIOD:

Entry submissions will be received beginning Wednesday, September 1, 2016 and will continue to be received until Monday, October 31, 2016.

 

JUDGING CRITERIA:

A team of leading Industry experts as chosen by TAP will select ten (10) semi-finalists among eligible entries.

The award will be judged by the following criteria:

 

  1. Off-Road Reliability
  2. Off-Road Capability
  3. Real World Functionality
  4. Quality of Craftsmanship
  5. Overall Presentation

 

From these ten eligible entries one (1) Jeep and one (1) non-Jeep (Truck or SUV) will be selected as finalists. From these finalists one (1) winner will be awarded.

 

TO ENTER:

To receive consideration an entry form must be completed. This entry form may be completed online at transamericanautoparts.com/award or downloaded from transamericanautoparts.com/award and e-mailed to [email protected]

Eligible entrants must submit the requested entry information in accordance with these official rules. No other method of submission will be accepted. Entries generated by script, macro or other automated or mechanical means or by any means which subvert the entry process are void. All entries become the property of TAP and will not be acknowledged or returned. By submitting an entry, you grant to TAP a perpetual royalty-free license to copy, distribute, modify, display and perform publicly and otherwise use, and authorize others to use, your images for any purpose throughout the world and in any media.

Winner receives:

  4. Recognition across Transamerican social media and digital channels
  5. Promotional email campaign spotlighting the award and winner(s)

  7. Invitation to be displayed in feature location at TAP-sponsored events, tradeshows, Truck & Jeep Fests, etc.
  8. Focus of PR campaign for 2016 award presentation
  9. Top 10 contenders receive ribbons / mentions / in conjunction with campaign

 

*THE ODDS OF WINNING SHALL DEPEND UPON THE TOTAL NUMBER OF ENTRIES RECEIVED.

If, for whatever reason, TAP is unable to provide any element of the prize, no compensation or substitution will be provided; however, remainder of prize package will be awarded and TAP will have no further obligation to winner. Winners may not substitute, assign or transfer a prize, but TAP reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at sole discretion of TAP.

 

 

 

PUBLICITY GRANT:

Each entrant, grants permission for TAP and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.

 

LIMITATIONS OF LIABILITY:

 

Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered, or garbled messages, notifications or entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the contest, the processing of entries, the announcement of the prizes, or in any contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the contest. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this contest or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the contest or website or who are in violation of these Official Rules, as solely determined by TAP, will be disqualified and all associated entries will be void. TAP reserves the right at its sole discretion to suspend, modify or terminate the contest (or any portion thereof) should any portion of the contest be, in TAP’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the TAP, corrupt or impair the administration, security, fairness or proper play, or submission of entries. If terminated, TAP may, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by TAP. Entrants, by participating, agree that TAP and their respective parents, subsidiaries, divisions, affiliated companies, dealers, service agencies, independent contractors, advertising and promotion agencies, web hosting and service and fulfillment providers, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize (including any travel or activity-related thereto) or participation in this contest.

 

As a contest participant, the Entrant and any personal guests, representatives, assigns, heirs and next of kin (herein referred to as “Participant”) hereby releases, waives, discharges and covenants not to sue Transamerican Auto Parts, the Las Vegas Convention and Visitors Authority, the Specialty Equipment Market Association, their directors, officers, employees, agents, representatives, servants, licensees, invitees, patrons, guests or contractors (herein referred to as “Releasees”) and each of them, from all liability to Participant for any and all loss or damage and any claim or demands therefore on account of injury to the person or property or resulting death of Participant arising out of or relating to the contest, whether caused by the negligence of the Releasees or otherwise. Participant hereby agrees to indemnify, save and hold harmless the Releasees and each of them from and against any loss, liability, damage or cost Releasees may incur from any and all claims, demands, actions, causes of actions, penalties, judgments and liabilities of every kind and description (including court costs and reasonable attorneys’ fees) for injury to or any death of persons, and damage to and loss of property which are caused by, arise from or grow out of the acts or omissions of Participant incident to the contest, SEMA Show, or from any breach by Participant of any term or condition of this Agreement. Participant hereby assumes full responsibility for any risk of bodily injury, death or property damage arising out of or related to the SEMA Show, whether caused by the negligence of Releasees or otherwise. Participant hereby agrees that this Release and Waiver, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by Releasees and is intended to be as broad and inclusive as is permitted by the laws of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

 

DISPUTES:

This contest shall be governed by and interpreted under the laws of the State of California, U.S.A. without regard to its conflicts of laws provisions. Entrants hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this contest or these Official Rules shall be resolved, upon the election by entrant or TAP, by arbitration pursuant to this provision and the code of procedures of either the Judicial Arbitration and Mediation Services, Inc. (“JAMS”) or the American Arbitration Association (“AAA”), as selected by the TAP. In addition to JAMS or AAA, Claims may be referred to any other arbitration organization that is mutually agreed upon in writing by entrant and TAP, or to an arbitration organization or arbitrator(s) appointed pursuant to Section 5 of the Federal Arbitration Act, 9 U.S.C. Sections 1-16, provided that any such arbitration organization and arbitrator(s) will enforce the terms of the restrictions on arbitration provision set forth below. IF ARBITRATION IS CHOSEN BY ANY PARTY WITHRESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT ORHAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER TAP NOR ENTRANT WILL HAVE THERIGHTTO PARTICIPATE IN REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OROTHERPERSONS SIMILARLY SITUATED, OR AS MEMBER OF ANY CLASS OF CLAIMANTSPERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. The arbitrator’s authority to resolve Claims is limited to Claims between TAP and entrant alone, and the arbitrator’s authority to make awards is limited to awards to TAP and entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration. Notwithstanding any other provision in these Official Rules and without waiving either party’s right to appeal such decision, should any portion of this provision be deemed invalid or unenforceable, then the entire provision (other than this sentence) shall not apply.

The winners list may be obtained after November 15, 2016 by sending a hand-printed, self-addressed, stamped envelope to: Transamerican Auto Parts “Life is Better Off-Road™” Winners List Request, Transamerican Auto Parts 400 W. Artesia Blvd. Compton, CA 90220. All requests must be received by December 31, 2016.
